Jail time for punch that gave stranger traumatic brain injury

A St. Paul man who assaulted a 55-year-old man over a littering complaint at a gas station was sentenced Thursday to five years of probation and a month of jail in Ramsey County District Court.

Antwoine Lamont McDaniel, 34, was charged with third-degree assault in July and pleaded guilty in August.

His victim suffered a subdural hematoma and traumatic brain injury after McDaniel punched him in the back of the head and left him bleeding on the ground. The victim had complained about McDaniel and his companions not cleaning up their trash at the Holiday Stationstore at 281 N. Snelling Ave., according to the criminal complaint.

District Judge Jennifer Frisch also ordered McDaniel to pay $2,178 in restitution, undergo a mental health evaluation, and participate in an anger-management program and counseling.

Frisch also granted McDaniel the opportunity to serve his jail sentence through home detention, work release or another program if he is eligible. This would let him begin paying restitution to the victim, Ramsey County attorney’s office spokesman Dennis Gerhardstein said.
